Terms of Use:
Please read these terms and conditions carefully before using our website or making a reservation. These terms of use apply to all our services. By using our website and making a reservation through our booking platform, you agree to be bound by the below terms and conditions which constitute an agreement between Zephyr Horses and you. If you do not agree with these terms, please do not use our services. This information is legally binding and by proceeding with a booking you acknowledge you have read and understood this information.
Prices, Payment Information, booking fees, & gift vouchers:
All prices are quoted in Australian Dollars unless otherwise stated. All credit card payments are subject to a 3% booking fee. Full payment is required to proceed with a booking unless alternate payment options are offered by Zephyr Horses. Gift Vouchers are valid to their dollar value rather than a specific experience, and are non-refundable.
Booking Confirmation:
Once you’ve made payment for your booking you will receive a booking confirmation email with important information regarding your booking. Please read this information carefully. If you notice any errors or have any questions regarding your booking, please reply to this email within 24 hours. Sometimes we will request additional information. If so, it is your responsibility to provide this information. All bookings are non-transferable. Riders must be the same person as confirmed at time of booking. In some circumstances, rider changes may be available. Zephyr Horses will assess this on a case-by-case basis.
Itinerary Changes, Cancellations and Refund policy:
For cancellations outside of 14 days we can provide a refund on the cost of your booking (excluding any booking fees), less a $55 administration fee, or a credit for the full amount. Cancellations within 14 days are fully non-creditable and non-refundable. Gift vouchers (and bookings made using gift vouchers) are non-refundable. Failure to turn up for your booking at the specified time ('no-show') will be considered a late cancellation. Zephyr Horses reserves the right to postpone or cancel any tour and our itineraries are subject to change. If your tour is postponed or cancelled, Zephyr Horses will endeavour to reschedule your booking to a suitable date and time, however if you are unable to do this we may be able to provide a credit for use within 12 months. We are unable to provide a refund if you are unable to reschedule. All bookings are non-transferable - you are unable to change participant details within 14 days of your booking. Please ensure you have the relevant travel insurance to cover you in the case of unforeseen events, including but not limited to Cyclones, Tsunamis, severe storms, travel restrictions, border closures, adverse weather, and like events.
Additional information regarding wet-weather and postponed rides:
As noted above, Zephyr Horses reserves the right to postpone or cancel any tour and our itineraries are subject to change. From time to time, we need to postpone rides as a result of the weather making it unsafe to ride. If we do need to postpone a ride as a result of adverse weather, we will endeavor to reschedule your booking to a suitable date and time, however if you are unable to do this we may be able to provide a credit for use within 12 months. We are unable to provide a refund if you are unable to reschedule. Please ensure you have the relevant travel insurance to cover you in the case of unforeseen events, including but not limited to adverse weather.
Additional information regarding covid-related cancellations:
As noted above, cancellations within 14 days of your ride are fully non-creditable and non-refundable. This includes cancellations that are related to covid-19. We do not recommend making a booking unless you are confident that you will be able to attend. If you are unable to attend and 14+ days notice has not been given, your booking will be considered a late-cancellation and we are unable to provide a credit or refund. Please ensure you have the relevant travel insurance to cover you in the case of unforeseen events, including but not limited to sickness or illness, isolation requirements, travel restrictions, border closures, and like events.
Safety, Liability, and Completion of Risk Waiver:
Zephyr Horses does not accept any liability for any injury, damage, loss, additional expense, or inconveniences caused by any events which are beyond our control. We accept no responsibility for climatic conditions that do not match your expectations. All activities engaged in are solely at your own risk and of your own choice. All riders must complete a Waiver of Liability prior to riding (riders under the age of 18 are unable to complete a waiver themselves and must have parent or guardian present to complete the waiver on their behalf). All riders must wear a helmet provided by Zephyr Horses. If you do not complete a Waiver of Liability, you will not be able to ride, and will be considered a late-cancellation (See 'Itinerary Changes, Cancellations and Refund policy'). If you choose not to wear a helmet, you will also not be able to ride, and will be considered a late-cancellation (See 'Itinerary Changes, Cancellations and Refund policy'). We are unable to take any persons who are intoxicated/under the influence of drugs or alcohol. Zephyr Horses reserves the right to refuse service to any persons who appear to be intoxicated. If you are not able to ride due to being intoxicated, you will be considered a late-cancellation (See 'Itinerary Changes, Cancellations and Refund policy').
Travel Insurance:
Zephyr Horses strongly recommends taking out the appropriate travel insurance at the time of booking. Travel insurance which includes both medical evacuation and horse riding coverage is also recommended. Under no circumstance will Zephyr Horses be responsible or liable for any costs or damages incurred as a result of inadequate insurance, lack of insurance or non-compliance of insurance obligation by you or any other third party. Please ensure you have the relevant travel insurance to cover you in the case of unforeseen events, including but not limited to sickness or illness, isolation requirements, travel restrictions, border closures, adverse weather, and like events.
Data collection, Privacy and security:
Information collected by Zephyr Horses is personal information, as defined by the Privacy Act 1998. This data includes your first name, last name, email address, telephone number and any medical conditions or special requirements. Zephyr Horses uses your personal information so you can identify yourself when making an online booking or registration, to contact you about a specific booking or registration, and to keep you informed of events that may be of interest to you. You may opt out of these communications via the unsubscribe link provided at the bottom of these emails. The Zephyr Horses website is protected by 128-bit Secure Sockets Layer technology. This is indicated by the padlock symbol on your browser and means that all data sent between your browser and the server is encrypted, including your log in, profile and credit card details. Credit card transactions are processed immediately using a secure payment gateway to the banking system, so we do not store your credit card details and provide you with instant feedback on the status of a transaction.
Governing Law:
This agreement will be governed and interpreted in accordance to the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of the State of New South Wales.
